What You Will Learn

In this section, you’ll learn about the roles of the three branches of government in shaping the criminal justice system. You’ll explore the significance of the U.S. Constitution in limiting criminal justice policies. Additionally, you’ll compare and contrast common objectives of the criminal justice system, delve into the “Nonsystem Argument,” and understand the importance of rules and discretion in criminal justice operations.

Student Learning Outcomes for Section 1.2

  • SLO 1: Describe the distinct roles of the legislative, judicial, and executive branches in the criminal justice system and how their actions shape criminal justice policy and practice.
  • SLO 2: Explain the purpose and process of judicial review, and differentiate between the functions of trial courts and appellate courts within the dual court system.
  • SLO 3: Analyze the goals of efficiency, effectiveness, and fairness in the criminal justice system and discuss how these objectives can sometimes be in tension with one another.
  • SLO 4: Evaluate the implications of discretion in criminal justice decision-making, particularly among law enforcement officers, prosecutors, and executive officials.
  • SLO 5: Summarize the historical development and foundational principles of the juvenile justice system and distinguish its rehabilitative focus from the adult criminal justice model.
