Course: Introduction / Criminal Law
Robbery (according to the UCR) is “The taking or attempting to take anything of value from the care, custody, or control of a person or persons by force or threat of force or violence and/or by putting the victim in fear.”
Robbery is a serious crime that is defined as taking or attempting to take anything of value from the care, custody, or control of another person by force or threat of force. According to the Uniform Crime Reporting (UCR) program, robbery is considered a violent crime and is included in the Crime Index, which also includes murder and non-negligent manslaughter, forcible rape, and aggravated assault.
Robbery is often seen as a more serious offense than theft, as it involves the use or threat of force. This can make it a traumatic experience for the victim and can also increase the likelihood of injury or death. In addition, robbery can have a significant impact on the victim’s sense of safety and security.
The UCR definition of robbery includes several key elements. First, there must be a taking or attempted taking of something of value. This can include money, jewelry, electronics, or any other item that has value. Second, the taking or attempted taking must be from the care, custody, or control of another person. This means that the victim must have possession or control of the item at the time of the robbery.
Third, the taking or attempted taking must be by force or threat of force or violence. This means that the offender must use physical force or the threat of physical force to take the item. This can include using a weapon, such as a gun or knife, or using physical force, such as pushing or hitting the victim.
Fourth, the taking or attempted taking must also involve putting the victim in fear. This means that the victim must feel threatened or intimidated by the offender. This can be accomplished through the use of force or the threat of force, or through other means, such as verbal threats.
Robbery can have a serious impact on victims, both in terms of physical harm and psychological trauma. Victims of robbery may suffer from injuries, such as bruises, cuts, or broken bones, as well as psychological effects, such as anxiety, depression, or post-traumatic stress disorder (PTSD).
