Section 3.3: Kidnapping and False Arrest

Fundamentals of Criminal Law by Adam J. McKee

In this chapter, we will look at crimes like abduction, false imprisonment, and kidnapping. These are serious crimes that involve taking away someone’s freedom against their will. To make it easier to understand, we’ll use the word “abduction” as a general term for all these related crimes. Later, we’ll explain the specific differences between them.

Abduction, false imprisonment, and kidnapping have long been part of legal systems. Understanding how these crimes have changed over time helps us understand why our laws are the way they are today. We’ll start by looking at how these crimes were treated in the past, especially by important legal thinkers like William Blackstone. Then, we’ll see how modern laws, like those in the Model Penal Code, handle these offenses today.

By the end of this chapter, you’ll have a better understanding of how these crimes have evolved and why they are still important to our legal system today.
